Abstract
“KAJIAN YURIDIS TERHADAP PENANGKAPAN KAPAL IKAN MALAYSIA YANG MELAKUKAN ILEGAL FISHING DI SELAT MALAKA DI TINJAU BERDASARKAN UNCLOS 1982).” Sonli Fadillah 1, Dwi Astuti Palupi1 Program Studi Ilmu Hukum, Fakultas Hukum Universitas Bung Hatta Email : sonlifadillah10@gmail.com ABSTRAC Illegal fishing is fishing activity in the fisheries management area of the Nation Republic of Indonesia WPPNRI which is carried out by a foreign country, which violates the provisions of Law No. 31 of 2004 in conjunction with Law 45 of 2009 concerning fisheries, and as regulated in Article 73 paragraph 1 UNCLOS 1982, as well as Article 102 Law of the Republic of Indonesia Number 31 of 2004 concerning Fisheries states that the punishment given to foreign fishing vessels may not include imprisonment, if there is no agreement between the countries concerned in the field of fisheries. Malaysian fishing vessels carrying out illegal fishing in the Malacca Strait are reviewed based on UNCLOS 1982? (2) How are the efforts made by the Indonesian government towards catching Malaysian fishing vessels carrying out illegal fishing in the Malacca Straits reviewed based on the 1982 UNCLOS? from books, research results, scientific papers related to research and literature, analyzed qualitatively. Based on the research: (1) Law enforcement against Malaysian fishing vessels carrying out illegal fishing in the Malacca Straits is subject to sanctions in the form of fines, sanctions administration, and bail, without imprisonment. This is in accordance with the provisions of international law and national law. (2) the Indonesian government has made legal efforts in accordance with the 1982 UNCLOS, this can be seen from the law enforcement process carried out by the Indonesian government based on Indonesian national regulations which are ratifications of the 1982 UNCLOS.
