Abstract

Production sharing agreement is an agreement entered into between a person entitled to a plot of agricultural land and another person who is called a Cultivator. However, conditions on the ground often violate the rules in the agreement. The problems in this research are: (1) How is the implementation of profit sharing from cultivating rice fields. (2) What is the production sharing sistem for cultivating rice fields. (3) Is it safe and the effort to solve problematic cultivation according to customary law in the village of Gunung Padang Alai, V Koto Timur Subdistrict, Padang Pariaman Regency. Research using this type of sociological juridical research, the main data are primary data, interview techniques and document studies, data were analyzed qualitatively. Results of the study: (1) Since ancient times, production sharing has been carried out using the mampaduoi sistem, where the land owner finances all the needs for land cultivation with the proviso for the results that 1/2 for the owner, 1/2 for the cultivator and now the mampatigoi sistem is used where the processing cost is borne by the cultivator of the provisions of the results, will be divided 2/3 part for the cultivator and 1/3 share for the owner. (2) The profit sharing sistem implemented in the village of Gunung Padang Alai at this time is Mampatigoi. (3) what was found in mampaduoi was that it was difficult to estimate the funds that had to be provided for the cultivator, the land owner was not in the village so it was difficult to contact him to ask for fees. The constraint in the mampatigoi sistem is that the costs required to cultivate the rice fields are very high, making it difficult for cultivators. Key words: Agreement, Profit sharing, Rice fields.
