Abstract

In international law there is a condition that must be met to be recognized as an existence of a state in the recognition of international law, this is regulated in the 1933 Montevideo Convention. In 2021 the Taliban group succeeded in controlling the entire territory of the country of Afghanistan and became the legal government of Afghanistan. France and Britain do not recognize Taliban rule. Formulation Problem: (1) How does the Taliban group position in international legal reviews (2) How is the juridical study of the Taliban as a group that succeeded in overthrowing the legitimate government of Afghanistan.The research uses normative legal research. The data sources used are secondary data consisting of primary, secondary and tertiary legal materials.The data collection technique used a document study and the data were analyzed qualitatively.conclusion of the research. (1) The position of the new Afghan government, which is currently led by the Taliban,is a form of acknowledgment that is only a statement from other countries and does not affect the status and existence of the new Taliban government in the international community. (2) The Taliban as a group that succeeded in overthrowing the legitimate government of Afghanistan that the coup carried out by the Taliban group was basically legal because international law does not regulate coups carried out by a group in a country.The United Nations Charter also prohibits interfering in the internal affairs of a country so that a coup can be done.
