Abstract

Political upheaval is bad enough to make Myanmar unable to maintain a democratic government. The military coup was carried out under the orders of General Ne Win who wanted to overthrow PM U Nu's civilian government and then establish a military junta as a source of power. Under the authoritarian rule of Ne Win, Myanmar turned into a country that has a repressive military regime and leaves many records of human rights violations in its implementation. The definition of gross human rights violation is explained in Law No. 39/1999 article 104 paragraph (1) and in the Rome Statute. The formulation of the problem is how to shoot civilians who are demonstrators in Myanmar in terms of the UDHR and what are the legal consequences for shooting civilians who are demonstrators in Myanmar. The research method is a normative legal approach. Data collection is done by document study. This act of shooting is strictly prohibited by international human rights provisions and national legislation. The prohibition is contained in the Universal Declaration of Human Rights (UDHR). Universally, the state bears the primary responsibility for the promotion and protection of human rights. Such a responsibility cannot be reduced for political, economic or cultural reasons. Meanwhile, in daily reality many human rights violations are carried out by the state through its organs or apparatus, both civilian and military, who abuse their power (abuse of power).
