Abstract

PELAKSANAAN PIDANA PELATIHAN KERJA OLEH JAKSA TERHADAP ANAK SEBAGAI PELAKU TINDAK PIDANA PENCABULAN (Studi Kasus Kejaksaan Negeri Padang) 1 Fauziya Ummu Salamah 1 1 Uning Pratimaratri 1 Yetisma Saini 1 Prodi Ilmu Hukum, Fakultas Hukum, Universitas Bung Hatta Email: f.salamah@yahoo.com ABSTRAK Criminal work training is one form of remedies that can be imposed on children. Remidi for children is regulated in Article 71 paragraph (1) of Law Number 11 of 2012 concerning the Child Criminal Justice System. The child labor training of the perpetrators of criminal acts of sexual abuse was carried out after the decision of the incumbent judge. Child work training is carried out by prosecutors at the Job Training Center. In the case of molestation committed by a child with the initials MCY, the sexual abuse of underage children was terminated by prison judges and job training because it violated Article 76 E of Law Number 35 of 2014 concerning Child Protection. The problems in this study: 1) how is the implementation of job training by the Prosecutor at the Padang District Prosecutor's Office against children as perpetrators of criminal acts of sexual abuse? 2) What are the obstacles faced by prosecutors at the Padang District Prosecutor's Office in implementing criminal work training for children as perpetrators of criminal acts of sexual abuse? This study used a socio-legal approach. The researcher used primary data and secondary data. Primary data obtained by interview, and secondary data obtained by document study. Data was analyzed qualitatively. Based on the research, it can be concluded that: 1) the criminal implementation of job training by prosecutors on children is carried out by participating in programs at the vocational training center, the program consists of several vocational courses including: vocational automotive engineering and vocational engineering electronics. 2) The obstacle faced by prosecutors in the implementation of criminal work training is a mismatch of the period of imprisonment of children in prison with a schedule of training at the Vocational Training Center.
